Motorcycle and Car Accidents: Wage Loss Information

After a motorcycle or car accident, what do you do about your lost wages a result of the incident?

In the event of a motorcycle or car accident, you are entitled to be compensated for your lost wages, subject to proof of that loss and supported by medical evidence of the cause for that loss (which is usually supplied by your treating doctor.)

Our case law, which we Phoenix car accident lawyers use, states that proof of the loss must include the rate of pay and time away from work. The proper measure of loss of wages is gross pay, not net or take home pay. If you have used sick time benefits or vacation time that was used in lieu of sick time, we will ask that you provide us with evidence of that loss, as it is a compensable element of damage.

Proof is going to come from your employer, since that is what the insurance company will require. Therefore, it is important that you keep an open line of communication with your employer regarding your car accident.

For example, if time taken for a doctor's visit is reported as personal to your employer it may not be compensable.

When we are ready for the preparation of your demand, we will ask that you provide us with evidence of your lost wages directly from your employer.

At our Phoenix accident law firm, we take pride in the effective way we are able to work out issues such as wage loss so that you, the client don't have to. However, we encourage our clients to be actively engaged in their case to the extent of their own choosing.
